August 11th ?Top 20 +? e-discovery compendium>SPOTLIGHT ...

Our?weekend edition of the??Top 20 ? plus more????a snapshot?of some interesting?e-discovery blog/web site?posts,?vendor news/views on a wide range of?electronic discovery related issues, and other tech developments from the past week.????It is compiled by e-discovery/social media professional?Rob Robinson who is Vice President of Marketing for?Orange Legal Technologies, a company that is a long-time member and?sponsor of The Posse List and The Electronic Discovery Reading Room.

Spotlight:??Predictive coding?s ?black box? technology (an FTI Consulting study)

As we have mentioned in previous posts, our European sister company Project Counsel staffs document reviews across Europe, almost all of its?assignments being?inside a corporation working with?in-house counsel.? The?number of European corporations?that have brought predictive coding technologies and other e-discovery technologies?in-house is striking.???For predictive coding, the predominant reason is not so much replacing costly human review with machine review but to prioritize documents for review and eliminate the chaff from the grain.??Reviewers focus on important materials while irrelevant materials are?culled out.?? In-house counsel can quickly see that these various technologies in their?most simplest form ? just, for example, concept searching as a?non-iterative exercise ? allow for?speedy?identification of?clusters of documents based on content, issues or topics.? You then move these subsets of documents through standard review workflows and control the first review/second review in-house (in an upcoming post we?ll discuss how in-house counsel are building/staffing these structures).

And what we see in the field is exactly what the FTI Consulting study bears out:? the top reasons corporations are using predictive coding is not to ?replace costly human review with machine review? but to ?prioritize documents for review ? to put important documents at the front of the review queue?.
